The FIFA Disciplinary Committee has decided to sanction three Indonesian clubs for breaching their obligation to keep data contained within the FIFA Transfer Matching System (TMS) strictly confidential.
The clubs Persebaya Surabaya and Persires Bali Devata have each been fined CHF 25,000 for publishing confidential data from TMS on club-affiliated Twitter accounts while PSIS Semarang must pay a fine of CHF 15,000 for re-publishing those tweets and publishing a confidential letter sent to them by FIFA TMS. The three clubs were also issued a reprimand. The sanctions are a result of the clubs violating article 3.4 of Annexe 3 of the FIFA Regulations on the Status and Transfer of Players.
These cases mark the first time the Disciplinary Committee has sanctioned clubs for such confidentiality breaches through the use of social media.
They follow preliminary investigations conducted by FIFA TMS GmbH – the FIFA subsidiary charged with ensuring that international transfers of professional male players are conducted correctly through the TMS, the use of which has been mandatory since October 2010. The data uploaded to the online platform must remain strictly confidential to the parties directly involved in a transfer, for the security of the more than 6,500 clubs and 209 member associations using the system.
The decisions were notified to the relevant parties today.
